PHOTOGRAPHY AGREEMENT WITH MODEL RELEASE
In exchange for this signed Model Release & Agreement, the client will receive:
1 hour photoshoot
5 retouched digital images with Print Release
More digital images maybe be purchased for $200/image
Collections & Wall Art can also be purchased
Client Usage: Client will only use the photographic materials, including but not limited to delivered digital files/images in accordance with the permissions within this Contract. Client’s images and prints are for personal use only and will not be submitted to contests or reproduced for commercial use. If Client has purchases additional digital images, the Studio will provide a digital file Print Release Form for all the images they selected, Client must act in accordance with the print release. Otherwise, Client will not make, or provide authorization to a third-party to make, reproductions of works resulting from this Contract without express permission of Studio.
Copyright and Reproductions: Studio will retain copyright ownership of all works created in the course of this Contract, including but not limited to all images in their original and processed formats. It is understood that any alteration of original images is strictly prohibited without the written permission of Studio, including pursuant to Copyright Law Title 17, Appendix V. Additional Provisions of the Digital Millennium Copyright Act 2005, Section 102. Alterations include, but are not limited to, application of filters, cropping, or modifications of any kind.
The Studio will provide a written Print Release Form to Client.
Client agrees that Client is responsible for Client’s own personal safety with respect to any exposure to COVID-19 as a result of participating in the photo shoot. Client understands the contagious nature of COVID-19 and voluntarily assumes the risk that Client may be exposed to or be infected by COVID-19 and accepts sole responsibility for any injury (including, but not limited to personal injury, disability, and death), illness damage, loss, claim, liability, or expense of any kind that Client may experience in connection with Client’s photo session (“Claims”). Client hereby releases, covenants not to sue, discharge, and hold harmless each of the Studio Parties, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. Client understand and agrees that this release includes any Claims based on the actions, omissions, or negligence of any of the Studio Parties, whether a COVID-19 infection occurs before, during, or after participation in the photo session.
Model Release: The Client hereby grants Photos By Yvonne LLC and its legal representatives and assigns an unrestricted right to use and publish photographs of the Client (or clients child) or in which the Client (or clients child) may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The Client hereby releases Photos By Yvonne LLC and its legal representatives and assigns from all claims and liability relating to said photographs.
